Overview / Responsibilities

Wood is currently recruiting for Commercial Director based in Atlanta, GA (preferred) or Houston, TX.

Authorization to work lawfully in the US without sponsorship from Wood is required

To play a key role in a high performing Commercial Intervention Team which will be deployed (i) at the front end of designated projects in order to ensure that the projects are properly set up from a Commercial perspective (ii) during project execution in order to provide support to project teams in connection with the identification, quantification and agreement of variations/change orders and (iii) in connection with the pursuit of commercial entitlement on projects by way of claims for extensions of time and/or additional costs and, where applicable, defence of commercial claims by Wood's clients and/or Wood's subcontractors.

  • Assist with the establishment of terms of reference for engagement of the Commercial Intervention Team when requested
  • Work with the relevant operating business in order to ensure that any projects identified for engagement of the Commercial Intervention Team are properly set up from a Commercial perspective
  • Work with the relevant operating business during the project execution of any projects identified for engagement of the Commercial Intervention Team in order to identify, quantify and agree contract variations/change orders
  • Work with the relevant operating business on any matters identified for engagement of the Commercial Intervention Team involving the pursuit of commercial entitlement by way of extension of time and/or additional cost claims
  • The Commercial Director will make sure that opportunities for claims against other parties are identified and pursued as appropriate (including suppliers, sub-contractors, JV partners and insurers)
  • The Commercial Director will have working knowledge of key standard forms of contract (including NEC, FIDIC, Federal, AIA and Consensus Docs forms of contract)
  • The Commercial Director will ensure he/she has up to date knowledge of significant Construction Law developments in key jurisdictions
  • The Commercial Director will ensure that Legal Department is involved in potential disputes at an early state, and that steps are taken to implement legal hold notices and to maintain legal privilege, in conjunction with Legal Department
  • The Commercial Director shall provide commercial support to Group Operations Assurance team in conducting project start-ups, peer reviews and audits as directed by the VP Contracts and Commercial


Skills / Qualifications

General:

• Extensive working knowledge and experience obtained through employment in Commercial roles within Industry or Practice; specific emphasis on the management of engineering & construction claims and disputes

• Degree in Quantity Surveying, Construction Management or equivalent is desirable

• Qualification/Membership with the Royal Institution of Chartered Surveyors (RICS), Association for the Advancement of Cost Engineering (AACE) or similar is desirable

Specific knowledge, skills and experience:

• Minimum of 15 years Commercial Management experience in the Engineering & Construction sector

• Comprehensive understanding of Engineering & Construction contracts

• Extensive experience in the development, defending and negotiation of claims

• Experience in formal dispute resolution (including arbitration, litigation and mediation)
