The Shell Technology Centre Bangalore, STCB, is one of the three global hubs for technology in the Projects & Technology business of Royal Dutch Shell. In addition, we supply crude, chemicals and technology to public and private sector oil companies, and our Chennai Business Centre provides a wide range of finance, accounting and business services to Shell globally. This role is accountable to the Managing Counsel. Global Litigation-Asia Pacific for the following:
-identifying legal issues relevant to matters handled and acting with the appropriate urgency; identifying general legal sensitivities and proposing solutions to the businesses with a clear sense of reality;
-handling a broad range of cases in a variety of areas including more complex cases in areas of developing expertise;
-identifying all potential problem areas with respect to cases and matters and relating them to client objectives;
-identifying option for achieving client objectives within applicable legal restraints and proposing legal resolutions to lawsuits, disputes and regulatory challenges;
-fully understanding the Shell Business Principles and Code of Conduct and challenging client decision making in respect of potential breaches;
-serving on external professional or industry bodies as appropriate and carrying a recognized representational role;
-periodically communicating with the client and updating the client litigation matters handling;
-reporting significant litigation risks within the Group Control framework;
-engagement and close management of external counsel;
-maintenance of matters on the Group-wide matter Management database;
-interfacing with lawyers in other organisations in Shell Legal Services regarding litigation risks impacting their areas of responsibility;
-liaising with communications and investor relations to provide messaging with respect to litigation matters that pose potentially high reputational risks for the group;
-as may be required from time to time, providing assistance to the Managing Counsel in managing high risk and high value litigation matters in India and other countries in the region, and in carrying out the other functions of Global Litigation in the Region.
The dimensions of this role include:
-responsible for handling low to medium exposure cases in a variety of areas and more complex and higher exposure cases in areas of developing expertise;
-responsible for all activity related to a docket of litigation matters or cases including case assessment process, strategy development, client communication, management of outside - counsel, recommendation of provisions and disclosures, settlement or resolution recommendations, and compliance with Shell policies and procedures relating to settlement authorities, - management of reputational issues and reporting lessons learned;
-responsible for assisting junior lawyers, paralegals, administrative assistants and other internal support resources in handling assigned matters;
-responsible for negotiating and managing the budget for each matter including the budget for external litigation counsel and all other expenses related to the matter; and
-responsible for coordination with appropriate stakeholders including ER, GR, IR, Sustainable Development, etc.
This position requires an experienced lawyer with hands-on trial experience in India. This position also requires a wide variety of legal issues and developing expertise in specific areas of the law. He/she must have excellent analytical skills and ability to identify and appreciate the significance of legal issues, recognize level and reputational risk and develop cost effective legal and business resolutions. The successful candidate must have excellent interpersonal and communication skills and be able to work effectively with business clients and internal and external stakeholders. He/she must have excellent skills as an advocate for his/her clients and as a legal counselor to the businesses. The successful candidate must also have excellent skills at managing outside legal resources.
